How to Correct Errors in the CFC Notification
If you have discovered an error in a previously submitted Notification of acquisition or divestiture of shares in a foreign legal entity, it can be corrected by following the steps outlined below according to the recommendations of the State Tax Service of Ukraine.
Step 1: Access the Electronic Cabinet
Navigate to the Electronic Cabinet website or through the DPS web portal. Access is facilitated through the use of an electronic digital signature.
Step 2: Select the Reporting Section
In the private section of the Electronic Cabinet, move to the “Enter Report” section. Use the top navigation panel to set the filter by parameters: “Year”, “Period”, specifying the current period for submitting the Notification.
Step 3: Choose the Form for Amendment
Select the form type “F13 Queries”. From the list of queries, choose the electronic form “Notification of acquisition (beginning of actual control) or divestiture of shares (cessation of actual control) by a Ukrainian resident in a foreign legal entity or property rights in shares in assets, income, or profits of an entity without legal status” with the form identifier J/F 1308001.
Step 4: Fill Out the Amending Form
In the “Document Status” field from the dropdown menu, select “amending document”. Enter the correct data and thoroughly describe the reasons for the corrections in line 24 “additional information (explanation) to the Notification”.
Step 5: Sign and Send the Document
After filling all the necessary fields, sign the document using an electronic digital signature and send it to the controlling authority.
Step 6: Receive Confirmation
Once your amending document has been processed, you will receive confirmation from the controlling authority that the corrections have been accepted.
